On Friday, unions scored a temporary victory to maintain their ability to collect union dues from Wisconsin public employees when Judge Maryann Sumi (the same judge who refused to order striking teachers back to work in February) issued a Temporary Restraining Order preventing the implementation of Wisconsin’s new law governing public-sector unions.Via the Wall Street Journal:
Judge Maryann Sumi said a lawsuit filed by the Dane County district attorney had enough merit for her to issue a temporary restraining order to prevent Secretary of State Doug La Follette from publishing the bill while she reviews the case.

This is a problem. Judge Maryann Sumi should have recused herself entirely from the Wisconsin

The viral video sensation showing a bullying incident at an Australian school has brought the issue of bullying back into the spotlight. Here in the United States, the Obama administration has made school bullying a federal issue. Last week, President Barack Obama addressed an anti-bullying conference with First Lady Michelle Obama at his side. The administration’s anti-bullying campaign has been ongoing since the beginning of Mr. Obama’s term.  The Department of Justice announced in December 2010 its intention to hold liable school districts that fail to protect students that are bullied.DOJ’s The Civil Rights Division and the entire Justice Department are committed to ending bullying and harassment in schools, and the video highlights the Department’s authority to enforce federal laws that protect students from discrimination and harassment at school because of their race, national origin, disability, religion, and sex, including harassment based on nonconformity with gender stereotypes.

The statement later says:

The enforcement of the Equal Protection Clause, Title IV of the Civil Rights Act of 1964, and Title IX of the Education Amendments of 1972 in school districts is a top priority of the Justice Department’s Civil Rights Division. Here is the catch. DOJ will only investigate bullying cases if the victim is considered protected under the 1964 Civil Rights legislation. In essence, only discrimination of the victim’s race, color, religion, sex or will be considered by DOJ. Two Michigan Dems Charged For Alleged Fake Tea Party Scheme

Two ex-leaders of the Oakland County Democratic Party are facing nine felony charges for allegedly committing voter fraud when attempting to get fake tea party candidates on Michigan ballots last November, as a way to pry support away from Republican candidates.Former Democratic Party Chairman Michael McGuinness and ex-operations director Jason Bauer were indicted Wednesday on forgery and perjury charges. Bauer also faces three counts of notary fraud.John Wisely of the Detroit Free-Press reports:
The indictment alleges that the pair attempted to place two county commission candidates, Aaron W. Tyler and Ruth Ann Spearman, and a state senate candidate, Johnathan M. Young, on the ballot without the candidates’ knowledge. The two men forged the signatures on the affidavit of identity and falsely swore under oath to qualify them to run, the indictment says.

“A scheme was devised by a party leader in Lansing to put people on the ballot on the Tea Party ticket,” Oakland Sheriff Michael Bouchard said. “It may not be ethical, but it’s not illegal. But some folks were placed on the ballot without their knowledge and that’s the criminal side.”As TPM has reported, Tea Partiers and Republicans in the state were suspicious that Michigan Tea Party was part of a scheme by Democrats to split the Republican vote, in the lead-up to the midterm elections. Bauer stepped down from his position following allegations that he notarized and filed papers for 13 sham candidates from the Michigan Tea Party.In September, Michigan Circuit Court judges authorized a one-man grand jury to investigate the allegations. The Michigan Supreme Court also blocked the fake candidates from appearing on the ballot.The two face up to 14 years in prison, if convicted. They were each released on a $25,000 personal bond, The Detroit News reports.

 Today former Congressman Ernest Istook testified before the House Energy and Commerce Health Subcommittee about the $105 billion slush fund in advance appropriations liberals tucked inside Obamacare. The $105 billion bypasses the traditional yearly budgeting process and is spread throughout the 2,700 page legislation. It took the Congressional Research Service (CRS) seven months to identify all the disparate funds and it was not until February (11 months after the bill passed) that all of the funds could be totaled up. Rep. Michele Bachmann (R-MN) has been beating the drum to raise awareness of this unprecedented level of advance spending. But the liberal media has been attacking her for calling it “hidden” funding. In reality, Rep. Bachmann said that “practically no Member of Congress even knew that $105 billion of funding was” in the bill.FactCheck says that this funding was known to “those who read the bill … including members of Congress.” But does FactCheck really believe that any member of Congress read all 2,700 pages of the bill? Do they have any evidence at all that any member of Congress knew about the $105 billion figure before CRS published their report this February? But more importantly, in their attempted take down of Rep. Bachmann, PolitiFactFactCheck, and The Washington Post Fact Checker all confirm her underlying charge: the $105 billion exists.
